High Court halts reinstatement of former IAS DMD Jennifer

The High Court has halted the reinstatement and compensation of former Deputy Managing Director of Island Aviation Services (IAS), Aishath Jennifer.

Jennifer was appointed as the Deputy Managing Director of Island Aviation in December 2018 during former President Ibrahim Mohamed Solih’s administration. She was removed from the post in January of this year by a decision made by the company’s board.

Following her dismissal, Jeniffer filed a case with the Employment Tribunal, which found that Jennifer’s dismissal was not due to circumstances warranting her dismissal and that her termination lacked both substantial justification and adherence to procedural fairness. The tribunal ordered Jennifer to be reinstated and paid her salary and allowances until the date the case was resolved.

However, the tribunal’s decision was challenged at the High Court by Island Aviation.

In a hearing held Tuesday, the Court halted the enforcement of the tribunal’s decision until the court made a decision on the matter. The decision was made unanimously by three judges on the bench.

If the tribunal’s ruling is upheld, IAS will be required to pay Jennifer over MVR 56,000 as monthly compensation for her unlawful dismissal.
