Island Aviation challenges reinstatement of former DMD

Island Aviation Services (IAS), the national airline operator of the Maldives, has filed an appeal with the High Court challenging the Employment Tribunal’s ruling to reinstate Aisha Jennifer as the company’s Deputy Managing Director.

Jennifer was appointed as the Deputy Managing Director of Island Aviation in December 2018 during former President Ibrahim Mohamed Solih’s administration. She was removed from the post in January of this year by a decision made by the company’s board.

Following her dismissal, Jeniffer filed a case with the Employment Tribunal, which found that Jennifer’s dismissal was not due to circumstances warranting her dismissal and that her termination lacked both substantial justification and adherence to procedural fairness. The tribunal ordered Jennifer to be reinstated and paid her salary and allowances until the date the case was resolved

Island Aviation appealed the decision in the High Court last week. However, the court has not yet accepted the case.

If the tribunal’s ruling is upheld, IAS will be required to pay Jennifer over MVR 56,000 as monthly compensation for her unlawful dismissal.
